Terms of Service
These Terms of Service (“Terms”) govern your access to and use of PreBid Intel WI (the “Platform”), operated by Steadfast Social Media LLC. By joining the waitlist, creating an account, or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform. Members in the beta program are also bound by the in-app Beta Tester Agreement; where the two conflict for beta users, the Beta Tester Agreement controls.
1. Eligibility
The Platform is restricted to licensed Wisconsin contractors. To become a member you must hold an active Wisconsin DSPS license, have a valid EIN and current Certificate of Insurance, and be approved by an administrator. We may approve, decline, or revoke membership at our discretion.
2. Accounts
- You must provide accurate, current information and keep it updated.
- You are responsible for activity under your account and for keeping access secure.
- Accounts are for your organization only — do not share access with non-members.
- We use passwordless magic-link sign-in; keep your email account secure.
3. Acceptable Use
You agree that all content you submit will be truthful and based on real, first-hand professional experience. You will not:
- Submit false, misleading, defamatory, or retaliatory reviews or flags.
- Submit content based on protected characteristics (race, ethnicity, national origin, religion, sex, family status, disability, or age) or engage in property- or neighborhood-based discrimination.
- Use the Platform for any FCRA-regulated purpose (see our FCRA Disclaimer).
- Scrape, resell, or redistribute Platform data, or share it outside the member network.
- Upload documents you lack the right to share, or attempt to disrupt or reverse-engineer the Platform.
4. Member Content
You retain ownership of the content you submit. You grant Steadfast Social Media LLC a non-exclusive, worldwide license to host, display, and use that content to operate and improve the Platform, including showing your reviews to other verified members attributed to you. You are solely responsible for the accuracy and legality of what you submit.
We may remove content or suspend accounts that violate these Terms, and we operate a dispute process for flagged parties as described in the member agreement.
5. Plans & Billing
Some features require a paid subscription. Paid plans are billed in advance through Stripe; the first month is prorated and renewals occur on the 1st. You can cancel at any time and retain access through the end of the paid period. Fees are non-refundable except where required by law. During the beta, plan availability and pricing may change.
6. Disclaimers
The Platform is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that any content is accurate or complete. The Platform is not a consumer reporting agency and its content is not a consumer report.
7. Limitation of Liability
To the fullest extent permitted by law, Steadfast Social Media LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any business decision you make based on Platform data. Our total liability for any claim relating to the Platform will not exceed the amount you paid us in the twelve months before the claim.
8. Indemnification
You agree to indemnify and hold harmless Steadfast Social Media LLC from any claims, damages, or costs arising from your content, your use of the Platform, your violation of these Terms, or your violation of any law or third-party right.
9. Termination
You may stop using the Platform at any time and request account deletion. We may suspend or terminate access for violations of these Terms or for any reason with notice. Sections that by their nature should survive termination (e.g., content license, disclaimers, limitation of liability, indemnification) will survive.
10. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Wisconsin.
11. Changes & Contact
We may update these Terms from time to time; material changes will be reflected by an updated Effective Date, and continued use constitutes acceptance. Questions? Contact taylor@steadfastsocialmedia.com.
These Terms are provided for general informational purposes and do not constitute legal advice. They are subject to review and revision.
